By using the 1NITA.my web site ("1NITA" or the "Site"), a service of 1NITA, 1NITA project partner (the "1NITA"), you (the "user" or "you") agree to be bound by the following terms and conditions (the "Terms of Use" or the "Agreement"), including those available by hyperlink.
Before you may become a member of 1NITA, you must read and accept all the terms and conditions in, and linked to, the Agreement.
1. 1NITA is a Marketplace
1NITA acts as a venue to allow users who comply with 1NITA's policies to offer, sell, and buy certain goods within a fixed price format. Please refer to About page to get detail of project 1NITA. 1NITA is not directly involved in the transaction between buyers and sellers. As a result, 1NITA has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. 1NITA does not pre-screen users or the content or information provided by users. 1NITA cannot ensure that a buyer or seller will actually complete a transaction.
Consequently, 1NITA does not transfer legal ownership of items from the seller to the buyer. 1NITA cannot guarantee the true identity, age, and nationality of a user. 1NITA encourages you to communicate directly with potential transaction partners through the tools available on the Site. You may also wish to consider using a third party escrow service or services that provide additional user verification.
You agree that 1NITA is a venue and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on 1NITA. You use the 1NITA service at your own risk.
2. Membership Eligibility
Age: 1NITA's services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use this service only in conjunction with and under the supervision of a parent or legal guardian. In this case, the adult is the user and is responsible for any and all activities.
Nationality & Gender: Only Malaysian women entrepreneur are eligible to do listing & sell items in WX platform.
Compliance: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes. In addition, you must abide by 1NITA's policies as stated in the Agreement and these 1NITA policy documents:

Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify 1NITA of any unauthorized use of your password or any breach of security. You also agree that 1NITA cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.
Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address.
Account Transfer: You may not transfer or sell your 1NITA account and User ID to another party. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.
Right to Refuse Service: 1NITA's services are not available to temporarily or indefinitely suspended 1NITA members. 1NITA reserves the right, in 1NITA's sole discretion, to cancel unconfirmed or inactive accounts. 1NITA reserves the right to refuse service to anyone, for any reason, at any time.
3. Limited License
Subject to the terms and conditions set forth in this Agreement, 1NITA grants you a non-exclusive, non-transferable, limited right to access, use and display this site and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the site in any way.
1NITA authorizes you to view and download the information ("Materials") at this Web site ("Site") only for your personal, non-commercial use. This authorization is not a transfer of title in the Materials and copies of the Materials and is subject to the following restrictions:
1) you must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials;
2) you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose; and
3) you must not transfer the Materials to any other person unless you give them notice of, and they agree to accept, the obligations arising under these terms and conditions of use. You agree to abide by all additional restrictions displayed on the Site as it may be updated from time to time. This Site, including all Materials, is copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of this Site and to prevent any unauthorized copying of the Materials. Except as expressly provided herein, 1NITA does not grant any express or implied right to you under any patents, trademarks, copyrights or trade secret information.
4. Copyrights
All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof, is the exclusive property of 1NITA or its licensors and is protected by Malaysia and international copyright laws. All rights not expressly granted are reserved.
5. Trademarks
The trademarks, service marks, designs, and logos (collectively, the "Trademarks") displayed on the Site are the registered and unregistered Trademarks of 1NITA and its licensors. You agree that you will not refer to or attribute any information to 1NITA or its licensors in any public medium (e.g., press release, Web sites) for advertising or promotion purposes, or for the purpose of informing or influencing any third party and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, 1NITA or its licensors.
6. User Postings
You acknowledge and agree that 1NITA shall own and have the unrestricted right to use, publish, and otherwise exploit any and all information that you post or otherwise publish on the Site in postings, survey responses, and otherwise, and you hereby waive any claims against 1NITA for any alleged or actual infringements of any rights of privacy or publicity, moral rights, or rights of attribution in connection with 1NITA's use and publication of such submissions. You covenant that you shall not post or otherwise publish on the Site any materials that (
(a) are threatening, libelous, defamatory, or obscene;
(b) would constitute, or that encourage conduct that would constitute, a criminal offense, give rise to civil liability, or otherwise violate law;
(c) infringe the intellectual property, privacy, or other rights of any third parties;
(d) contain a computer virus or other destructive element;
(e) contain advertising; or
(f) constitute or contain false or misleading statements. 1NITA does not and cannot review all information posted to the Site by users and is not responsible for such information. However, 1NITA reserves the right to refuse to post and the right to remove any information, in whole or in part, for any reason or for no reason.
7. Fees and Services
Joining and setting up a shop on 1NITA is free. 1NITA charges fees for listing an item for sale more than 20 items for 1NITA project participant (See detail in About 1NITA project webpage), as well as a percentage of the sale price when the item sells. When you list an item you have an opportunity to review and accept the fees that you will be charged. 1NITA's Fees Policy, which is subject to change, is incorporated into this Agreement by reference. Changes to the Fees Policy and the fees for 1NITA's services are effective after 1NITA provides you with at least fourteen (14) days' notice by posting the change on the Site. However, 1NITA may choose to temporarily change the Fees Policy and the fees for 1NITA's services for promotional events (for example, free listing days); such changes are effective when 1NITA posts the temporary promotional event on the Site. 1NITA may, at 1NITA's sole discretion, change some or all of 1NITA's services at any time. In the event 1NITA introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in Malaysia Ringgit (MYR).
You are responsible for paying all fees associated with using 1NITA. 1NITA keeps sellers' valid credit card or other accepted payment information on file. At the beginning of the month, each seller is emailed an invoice detailing the amount due. A seller must pay the amount due in full within 15 days of the date of the invoice. If the seller's account is not paid in full, the seller risks penalties such as the suspension of privileges and/or termination of the account.
Fees and Termination: If 1NITA terminates your account, if you close your account, or if the payment of your 1NITA fees cannot be completed for any reason, you remain obligated to pay 1NITA for all unpaid fees plus any penalties, if applicable. If you have a question or wish to dispute a charge, contact 1NITA.
8. Listing and Selling
Listing Description: By listing an item on the Site you warrant that you and all aspects of the item comply with 1NITA's policies. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale in your 1NITA shop. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category with appropriate tags. Each listing must accurately and completely describe the item/items for sale in that listing. If the "in stock" quantity is more than one, all items in that listing must be identical. Each unique item must have its own listing.
Shop Policies: All sellers are urged to outline shop policies for their 1NITA shop. These policies may include, for example: shipping, returns, payment and selling policies. Sellers must create reasonable policies in good faith and must abide by such policies. All shop policies must comply with 1NITA's site-wide policies. Sellers are responsible for enforcing their own reasonable shop policies. 1NITA reserves the right to request that a seller modify a shop policy.
Binding Sale: All sales are binding. The seller is obligated to ship the order or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of the seller's listing (such as payment method), or (b) the seller cannot authenticate the buyer's identity. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance.
Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the items. Sellers may not charge excessive shipping fees or otherwise avoid fees. You may not alter the item's price after a sale for the purpose of avoiding 1NITA transaction fees, misrepresent the item's location, or use another user's account without permission.
9. Prohibited, Questionable and Infringing Items and Activities
You are solely responsible for your conduct and activities on and regarding to 1NITA and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links (together, "Content") that you submit, post, and display on 1NITA.
Restricted Activities:
Your Content and your use of 1NITA shall not:
1. Be false, inaccurate or misleading
2. Be fraudulent or involve the sale of illegal, counterfeit or stolen items
3. Infringe upon any third party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy (See also, 1NITA's Copyright and Intellectual Property Policy
4. Violate this Agreement, The Prohibited & Restriction Items, any site policy or community guidelines, or any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising)
5. Contain items that have been identified by Ministry of Domestic Trade, Co-operatives And Consumerism as hazardous to consumers and therefore subject to a recall
6. Be defamatory, trade libelous, unlawfully threatening, unlawfully harassing, impersonate or intimidate any person (including 1NITA staff or other users), or falsely state or otherwise misrepresent your affiliation with any person, through for example, the use of similar email address, nicknames, or creation of false account(s) or any other method or device
7. Be obscene or contain child pornography
8. Contain or transmit any code of a destructive nature that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
9. Host images not part of a listing
10. Modify, adapt or hack 1NITA or modify another website so as to falsely imply that it is associated with 1NITA;
11. Appear to create liability for 1NITA or cause 1NITA to lose (in whole or in part) the services of 1NITA's ISPs or other suppliers
12. Link directly or indirectly, reference or contain descriptions of goods or services that are prohibited under this Agreement, the Privacy Policy, The Prohibited & Restriction Items of 1NITA, or other policy documents as posted on 1NITA.
Furthermore, you may not list any item on 1NITA (or consummate any transaction that was initiated using 1NITA's service) that, by paying to 1NITA the listing fee or the final value fee, could cause 1NITA to violate any applicable law, statute, ordinance or regulation, or that violates the Terms of Use.
10. Content
License: 1NITA does not claim ownership rights in your Content. You grant 1NITA a license solely to enable 1NITA to use any information or Content you supply 1NITA with, so that 1NITA is not violating any rights you might have in that Content. You grant 1NITA a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the Content, in any media now known or not currently known, with respect to your Content. You agree to allow 1NITA to store or re-format your Content on 1NITA and display your Content on 1NITA in any way as 1NITA chooses. 1NITA will only use personal information in accordance with 1NITA's Privacy Policy.
As part of a transaction, you may obtain personal information, including email address and shipping information, from another 1NITA user. Without obtaining prior permission from the other user, this personal information shall only be used for that transaction or for 1NITA-related communications. 1NITA has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any 1NITA user to your email or physical mail list. For more information, see 1NITA's Privacy Policy.
Re-Posting Content: By posting Content on 1NITA, it is possible for an outside website or a third party to re-post that Content. You agree to hold 1NITA harmless for any dispute concerning this use. If you choose to display your own 1NITA-hosted image on another website, the image must provide a link back to its listing page on 1NITA.
11. Information Control
1NITA does not control the Content provided by users that is made available on 1NITA. You may find some Content to be offensive, harmful, inaccurate, or deceptive. There are also risks of dealing with underage persons or people acting under false pretense.
Additionally, there may also be risks dealing with international trade and foreign nationals. By using 1NITA, you agree to accept such risks and that 1NITA (and 1NITA's officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on 1NITA. Please use caution, common sense, and practice safe buying and selling when using 1NITA.
Other Resources: 1NITA is not responsible for the availability of outside websites or resources linked to or referenced on the Site. 1NITA does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that 1NITA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.
12. Resolution of Disputes and Release
In the event a dispute arises between you and 1NITA, please contact 1NITA.
Should you have a dispute with one or more users, or an outside party, you release 1NITA (and 1NITA's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. 1NITA encourages users to report user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.
1NITA, for the benefit of users, may try to help users resolve disputes. 1NITA does so in 1NITA's sole discretion, and 1NITA has no obligation to resolve disputes between users or between users and outside parties. To the extent that 1NITA attempts to resolve a dispute, 1NITA will do so in good faith based solely on 1NITA's policies. 1NITA will not make judgments regarding legal issues or claims.
13. 1NITA's Intellectual Property
1NITA, and other 1NITA graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of 1NITA, Inc. in the U.S. and/or other countries. 1NITA's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.
14. Access and Interference
1NITA may contain robot exclusion headers which contain internal rules for software usage. Much of the information on 1NITA is updated on a real-time basis and is proprietary or is licensed to 1NITA by 1NITA's users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access 1NITA for any purpose without 1NITA's prior express written permission. Additionally, you agree that you will not:
1.Take any action that imposes, or may impose, in 1NITA's sole discretion, an unreasonable or disproportionately large load on 1NITA's infrastructure
2.Copy, reproduce, modify, create derivative works from, distribute or publicly display any user Content (except for your Content, or other allowed uses as set out in the Prohibited & Restriction Item of 1NITA from the Site without the prior expressed written permission of 1NITA and the appropriate third party, as applicable
3.Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site
4.Bypass 1NITA's robot exclusion headers or other measures 1NITA may use to prevent or restrict access to 1NITA
15. Breach
Without limiting any other remedies, 1NITA may, without notice, and without refunding any fees, delay or immediately remove Content, warn 1NITA's community of a user's actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user's account privileges, terminate a user's account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:
1NITA suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, the Prohibited & Restriction Item of 1NITA or other policy documents and community guidelines incorporated herein; 1NITA is unable to verify or authenticate any of your personal information or Content; Or 1NITA believes that a user is acting inconsistently with the letter or spirit of 1NITA's policies, has engaged in improper or fraudulent activity in connection with 1NITA or the actions may cause legal liability or financial loss to 1NITA's users or to 1NITA.
16. Privacy
Except as provided in 1NITA's Privacy Policy 1NITA will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent. 1NITA stores and processes Content on computers located in the Malaysia that are protected by physical as well as technological security.
17. No Warranty
1NITA, 1NITA's subsidiaries, officers, directors, employees, and 1NITA's suppliers provide 1NITA's web site and services ?as is? and without any warranty or condition, express, implied or statutory. 1NITA, 1NITA's subsidiaries, officers, directors, employees, and 1NITA's suppliers specifically disclaim any implied warranties of title, merchantability, performance, fitness for a particular purpose and non-infringement. In addition, no advice or information (oral or written) obtained by you from 1NITA shall create any warranty. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.
18. Liability Limit
In no event shall 1NITA, and (as applicable) 1NITA's subsidiaries, officers, directors, employees or 1NITA's suppliers be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the site, 1NITA's services, or this agreement, including without limitation, lost profits, bodily injury, emotional distress, or any special, incidental or consequential damages.
1NITA's liability, and (as applicable) the liability of 1NITA's subsidiaries, officers, directors, employees, and suppliers, to you or any third parties in any circumstance is limited to the greater of
(A) the amount of fees you pay to 1NITA in the 12 months prior to the action giving rise to liability, and
(B) $100.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
19. Indemnity
You agree to indemnify and hold 1NITA and (as applicable) 1NITA's parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
20. No Guaranty
1NITA does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside 1NITA's control.
21. Legal Compliance
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of 1NITA's service and your listing, purchase, solicitation of offers to purchase, and sale of items.
22. Severability
If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
23. No Agency
You and 1NITA are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
24. 1NITA Service
1NITA reserves the right to modify or terminate the 1NITA service for any reason, without notice, at any time. 1NITA reserves the right to alter these Terms of Use or other Site policies at any time. If the alterations constitute a material change to the Terms of Use, 1NITA will notify you via email to the email address in your account. What constitutes a "material change" will be determined at 1NITA's sole discretion, in good faith, and using common sense and reasonable judgment.
25. Disclaimer
The materials may contain inaccuracies and typographical errors. Radicalbox does not warrant the accuracy or completeness of the materials or the reliability of any advice, opinion, statement or other information displayed or distributed through the site. You acknowledge that any reliance on any such opinion, advice, statement, memorandum, or information shall be at your sole risk. Radicalbox reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the site. Radicalbox may make any other changes to the site, the materials and the products, programs, services or prices (if any) described in the site at any time without notice.

28. Changes
RadicalBox reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement in whole or in part, at any time. Changes in this Agreement will be effective when notice of such change is posted. Your continued use of the Site after any changes to this Agreement are posted will be considered acceptance of those changes. RadicalBox may terminate, change, suspend or discontinue any aspect of the RadicalBox Site, including the availability of any features of the Site, at any time. RadicalBox may also impose limits on certain features and services or restrict your access to parts or all of the Site without notice or liability. RadicalBox may terminate the authorization, rights and license given above and, upon such termination, you shall immediately destroy all Materials.
29. Governing Law; Jurisdiction
Your use of this website and the operation of the terms and conditions contained herein shall be governed in accordance with the laws of Malaysia. Any dispute arising out of or in relation to this website, including these terms and conditions shall be subject to the exclusive jurisdiction of the Malaysian courts.

1nita is committed to protecting the intellectual property rights of third parties and to providing 1nita members with a safe place to trade. Infringement is the unauthorized use of other people's intellectual property, like copyrighted material and trademarks.
Rules that affect what you can sell on 1nita
The following items are restricted or prohibited because they would potentially infringe on intellectual property rights:-
1) Replica, counterfeit items and unauthorized copies
2) Celebrity material including faces, names and signatures, and autographs
3) Media - movie prints (35 mm, 70 mm), bootleg recordings, recordable media, promotional copies and digitally delivered goods.
4) Software including academic software, beta software, OEM software

Rules that affect how you list items for sale
In an item listing, 1nita members cannot:
1) Encourage or enable others to infringe copyrights, trademarks or other rights.
2) Improperly use 1nita Intellectual Property (including use of the 1nita name, logo or linking to the 1nita Web site).
3) Include authenticity disclaimers or deny responsibility for the items offered in their listings.
4) Use another member's item description or picture without their permission. (To contact 1nita about another member who is using your text or images without your permission, email to report@1nita.my with the screenshot of the text or images.)
1nita's IP Programme - Reporting Listing Violations
1nita created the IP Programme so that intellectual property owners could easily report listings that infringe their rights. It is in 1nita's interest to ensure that infringing items are removed from the site, as they erode buyer and good seller trust.

If you are a Verified Intellectual Property (IP) Rights Owner and want to report a listing issue, you can contact us at report@1nita.my.
Note: Only the intellectual property rights owner can report potentially infringing items or listings through report@1nita.my. If you are not the intellectual property rights owner, you can still help by getting in touch with the rights owner and encouraging them to contact us at report@1nita.my.
